Meta faces court scrutiny over Lula campaign’s unequal-treatment claims

Lula’s coalition argues that unexplained platform restrictions and uneven reach may have tilted the digital playing field toward Flávio Bolsonaro, while the electoral court has not endorsed that conclusion and is seeking Meta’s technical records before deciding whether to intervene.

Lula’s campaign has cast its complaint as more than a dispute over social-media metrics. Its coalition says Meta’s handling of Facebook and Instagram content showed signs of unequal treatment, including disproportionate engagement, inconsistent measurements on Lula-related posts and restrictions on campaign activity. It said the company’s unexplained technical problems created “strong suspicion” of an attempt to interfere in Brazil’s electoral process for Flávio Bolsonaro’s benefit.

The campaign also said the alleged restrictions affected messages on ending online betting, the six-day workweek debate and social programmes. The legal group Prerrogativas separately pointed to the temporary disabling of Lula’s Facebook page and limits on its advertising account, arguing that the episodes warranted a rigorous inquiry into possible algorithmic manipulation and foreign interference.

The Superior Electoral Court, however, has taken a narrower procedural view. Justice Marco Aurélio Bellizze gave Meta 48 hours to explain whether it applied the same treatment to Lula’s and Flávio Bolsonaro’s second-round campaigns, while ordering the company to retain moderation logs, metrics and advertising records.

Bellizze noted that much of the coalition’s initial material was indirect, drawing on reporting, civil-society studies and user accounts. Rather than immediately ruling on the requested injunction, he sought a technical record: Meta must explain any reach reductions, labels, blocks or removals since 16 August 2026; clarify video-view counting; justify the ad-account suspension; and address an alleged network of 255 AI-operated Instagram profiles.

The court also requested underlying methodologies from Agência Lupa and Instituto Democracia em Xeque. Meta’s submissions will remain under seal because they may contain internal technical data and third-party records, after which Lula’s coalition and the electoral prosecutor’s office will be heard before the court considers interim relief.
