How did the trial over Moraes end and what happens now?

Dino's request for review interrupted the session before the STF reached the main point: deciding whether Moraes will be investigated.

How did the trial over Moraes end and what happens now?

TL;DR

  • The STF session to decide on an investigation into Alexandre de Moraes was suspended.
  • Minister Flávio Dino requested a review, delaying the central decision.
  • Disputes arose over how the judgment should proceed and potential case mergers.
  • Ministers Gilmar Mendes, Luiz Fux, and Alexandre de Moraes engaged in direct confrontations.
  • The Moraes case is suspended and will resume after Dino returns the process.
  • A proposal to merge Moraes' case with André Mendonça's was rejected.
  • The STF's session concluded without deciding whether Moraes would be investigated.

The STF spent a good part of Tuesday discussing a case that, in the end, did not even reach its central point.

The session had been called to analyze the process involving Moraes and the Federal Police report on his alleged relations with Daniel Vorcaro.

However, before deciding whether there would be an investigation, the ministers entered into another dispute: how the judgment itself should proceed.

It was at this point that Flávio Dino requested a review and interrupted everything.

What happens now?

On Wednesday, the STF will meet again at 2 p.m., but the Moraes case remains suspended. The judgment can only be resumed after Flávio Dino returns the process to the plenary.

A request for review means that a minister wants more time to analyze the process. Dino can return the case whenever he wants, but has up to 90 consecutive days, counted from the publication of the minutes.

After the return, it will be up to President Edson Fachin to put it back on the agenda.

And there is still a step before discussing Moraes' case.

Gilmar Mendes proposed merging Moraes' case with the process concerning André Mendonça. Four ministers voted against the merger and three in favor.

The STF also has a session scheduled for September 23 to analyze accusations related to Mendonça. Yesterday's impasse could alter this schedule.

How was yesterday's session?

The session began with Fachin asking for serenity. Shortly after, Kassio Nunes Marques declared himself imped ed. Dias Toffoli cited a reason of private forum to declare himself suspicious.

Then the debate changed course.

Dino questioned Fachin's decisions on the rapporteurships. Gilmar Mendes criticized the removal of the Federal Police director-general, Andrei Rodrigues, determined by Mendonça. Luiz Fux retorted and defended the decision.

Then came the direct confrontations.

Moraes accused Mendonça of political action. Mendonça called one of his colleague's statements "frivolous." At another point, he said that a statement by Moraes was "a lie."

In the afternoon, the discussion moved to the possibility of merging the two cases. Before the STF could even resolve this preliminary issue, Dino requested a review.

Result: after hours of session, the Court ended the day without deciding whether Alexandre de Moraes will be investigated or not.
